Terms of Use — InstaHuman

These Terms govern your use of InstaHuman, operated by Hallway LLC (DBA InstaHuman).

1. Platform Role

InstaHuman is a marketplace platform connecting developers and testers.

  • We are not a party to task agreements
  • We do not employ testers
  • Testers act as independent contractors

2. Eligibility

  • You must be at least 16 years old
  • If under 18, you must have parental or guardian permission
  • You must provide accurate account information

3. Accounts

You agree to:

  • Maintain accurate information
  • Keep your account secure
  • Not create multiple or fraudulent accounts

We may suspend or terminate accounts at our discretion.

4. Marketplace Functionality

Developers:

  • Create and publish tasks
  • Define targeting criteria
  • Provide content for evaluation

Testers:

  • Select and complete tasks
  • Provide feedback and responses

We do not guarantee:

  • Task availability
  • Participation levels
  • Quality or accuracy of responses

5. Payments and Fees

Developer Payments:

  • Developers pay the task amount plus a platform service fee (e.g., 30%)
  • The service fee is charged in addition to tester compensation

Tester Compensation:

  • Testers receive the full task payment
  • Platform fees are not deducted from tester earnings

Payment Processing:

Payments and payouts are handled by third-party providers (e.g., Stripe).

We are not responsible for:

  • Payment delays
  • Third-party processing issues

6. Unpaid Tasks

Developers may create unpaid tasks.

  • Developers must maintain a valid payment method
  • We may limit unpaid task creation to prevent abuse

7. Content and Licensing

Developer Content:

Developers retain ownership of content they submit but grant us a license to host, process, and display it.

Tester Submissions:

By submitting responses, testers grant developers a:

  • Worldwide
  • Perpetual
  • Royalty-free license to use the submitted feedback.

8. Acceptable Use

You agree not to:

  • Submit illegal, harmful, or abusive content
  • Attempt to identify or re-identify testers
  • Circumvent payment systems
  • Engage in fraud or manipulation
  • Use the platform for unlawful research or data collection

9. Data Use Restrictions (Developers)

Developers may not:

  • Attempt to identify testers
  • Combine data to re-identify individuals
  • Use data for unlawful or discriminatory purposes

10. Quality and Enforcement

We may:

  • Remove tasks or content
  • Reject submissions
  • Withhold payouts in cases of fraud or abuse
  • Limit or restrict platform usage

11. Payment Method Requirement

We may require developers to maintain a valid payment method to:

  • Create tasks
  • Access certain features

12. Rate Limiting and Abuse Prevention

We may impose limits on:

  • Task creation
  • API usage
  • Platform activity

to ensure system stability and prevent abuse.

13. Disclaimer of Warranties

The platform is provided “as is” without warranties of any kind.

We do not guarantee:

  • Accuracy of feedback
  • Availability of testers
  • Suitability for any specific purpose

14. Limitation of Liability

To the maximum extent permitted by law:

InstaHuman shall not be liable for indirect, incidental, or consequential damages.

Our total liability is limited to the amount paid by you to the platform in the past 12 months.

15. Termination

We may suspend or terminate access at any time.

Users may stop using the platform at any time.

16. Governing Law

These Terms are governed by the laws of the United States and the State of Maryland.

17. Changes to Terms

We may update these Terms from time to time. Continued use constitutes acceptance.
